2018-19 school budget hearing, vote and election legal notice

The following legal notice is published in the Daily Gazette in April and May 2018

DUANESBURG CENTRAL SCHOOL DISTRICT
NOTICE OF ANNUAL MEETING, BUDGET VOTE AND ELECTION

NOTICE IS HEREBY GIVEN, that a public hearing of the qualified voters of the Duanesburg Central School District will be held in the Elementary Cafeteria at 165 Chadwick Road in the Town of Duanesburg on May 8, 2018 at 6:30 PM prevailing time, for the presentation of the budget. The budget will be available for review beginning April 18, 2018 at the District Office, 133 School Drive, Delanson.

NOTICE IS HEREBY GIVEN, that the annual meeting of the qualified voters of the Duanesburg Central School District will be held in the District Offices, 133 School Drive, Delanson, on Tuesday, May 15, 2018, between the hours of 1:00 PM and 9:00 PM, prevailing time, at which time the polls will be opened to vote by machine ballot upon the following items:

1. To adopt the annual budget of the Duanesburg Central School District for the fiscal year 2018-19 and to authorize the requisite portion therefore to be raised by taxation on the taxable property on the District.

2. To adopt the following propositions:

RESOLVED, that the Board of Education is hereby authorized to acquire three (3) passenger school buses at a maximum estimated cost not to exceed $270,000, which is estimated to be the maximum cost thereof, and (2) to expend such sum for such purpose and (3) to levy the necessary tax therefore taking into account state aid received, to be levied and collected in annual installments in such years and in such amounts as may be determined by the Board of Education and (4) in anticipation of the collection of such tax, issue bonds and notes of the District at one time or from time to time in the principal amount not to exceed $270,000 and to levy a tax to pay the interest on such obligations when due.

RESOLVED, that the Board of Education of Duanesburg Central School District is hereby authorized to (1) establish a Capital Reserve Fund for the purpose of financing the construction of general improvements, reconstruction, renovations, or additions to the District’s buildings, including site work and the acquisition of original furnishings, equipment, machinery or apparatus required for the purpose for which such buildings are used; and (2) deposit annually into the Capital Reserve Fund such portion of the General Fund excess as determined by the Board. The ultimate amount of the Capital Reserve Fund shall be $6,000,000 and the probable duration of the Fund is ten (10) years.

3. To elect three (3) members of the Board of Education for three (3) year terms, commencing on July 1, 2018 and expiring on June 30, 2021 to succeed Dirk Felton, Christina Loukides and Joshua Menzies whose terms expire on June 30, 2018.

4. To transact such other business as may properly come before the meeting pursuant to the Education Law of the State of New York.

AND FURTHER NOTICE IS HEREBY GIVEN that a copy of the statement of the amount of money which will be required to fund the School District’s budget for the 2018-19 school year, exclusive of public monies, may be obtained by any taxpayer in the District during the fourteen days immediately preceding the Annual Meeting except Saturdays, Sundays or holidays, at District school buildings between the hours of 8:00 a.m. and 4:00 p.m., prevailing time and also at said District Election.

The election and budget vote shall be by machine or absentee ballot. The hours during which the polls shall be kept open shall be from 1:00 p.m. to 9:00 p.m., prevailing time, or for as long thereafter as necessary to enable qualified voters who are in the polling place at 9:00 p.m. to cast their ballots.

AND FURTHER NOTICE IS HEREBY GIVEN that petitions nominating candidates for the office of member of the Board of Education shall be filed with the Clerk of the Duanesburg Central School District at 133 School Drive, not later than April 16, 2018 at 4:00 p.m. Each petition shall be directed to the Clerk of the District and shall be signed by at least twenty-five (25) qualified voters of the District, and must state the full name and residence of the candidate. Information packets are available from the District Clerk. Three positions are to be filled with a term of three years.

AND FURTHER NOTICE IS HEREBY GIVEN that applications for absentee ballots will be obtainable between the hours of 8:00 AM and 4:00 PM Monday through Friday, except holidays, from the District Clerk or on our web site at www.duanesburg.org. Completed applications for absentee ballots must be received by the District Clerk by May 7, 2018 if the ballot is to be mailed to the voter, or May 14, 2018, if the ballot is to be delivered personally to the voter. Absentee ballots must be received by the District Clerk not later than 5:00 p.m. on May 15, 2018.

A list of all persons to whom absentee ballots shall have been issued will be available in the office of the District Clerk from 9:00 a.m. until 4:00 p.m. prevailing time on each of the five days prior to the day of the election, except weekends, and on the day set for the election. Any qualified voter may challenge the acceptance of the ballot of any person on such list, by making his/her challenge and reasons therefor known to the Inspector of Election before the close of the polls.

AND FURTHER NOTICE IS HEREBY GIVEN that the qualified voters of the School District shall be entitled to vote in said annual vote and election. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen (18) years of age or older, and (3) resident within the School District for a period of thirty (30) days preceding the annual vote and election. The School District may require all persons offering to vote at the budget vote and election to provide one form of proof of residency pursuant to Education Law section 2018-c. Such form may include a driver’s license, a non-driver identification card, a utility bill, or a voter registration card. Upon offer of proof of residency, the School District may also require all persons offering to vote to provide their signature, printed name and address.

AND FURTHER NOTICE IS HEREBY GIVEN that any other proposition not requiring official notice in the call of the Annual Meeting may be voted upon at said election, subject to the provisions of Section 2035 of the Education Law, provided a proposition is filed with the District Clerk on or before April 16, 2018 at 5:00 p.m. prevailing time; said proposition must be typed or printed in the English language; must be directed to the Clerk of the School District; must be signed by at least twenty-five (25) qualified voters of the District; and must state the name and residence of each signer. The School Board will not entertain any petition to place before the voters any proposition the purpose of which is not within the powers of the voters to determine, or any proposition which fails to include a specific appropriation where the expenditure of monies is required by the proposition.
